OVERVIEW
Welcome to LANYU. This website and online store are operated by the legal company identified above, trading as LANYU. In these Terms of Service, “LANYU”, “we”, “us” and “our” refer to that company.
LANYU is an independent UK-based stationery store offering a curated selection of paper goods, journaling supplies and creative products from brands and independent studios, primarily from across Asia, together with occasional products expressly identified as LANYU originals.
Our store is powered by Shopify, which provides the ecommerce platform used to operate the website and checkout. Purchases made through the store are contracts directly between you and LANYU, not between you and Shopify.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policy expressly referred to in them, apply when you browse the website, create an account, place an order or otherwise use our website, products and related services (together, the “Services”).
Please read these Terms carefully. By using the Services, you agree to these Terms. If you do not agree, you should not use the Services. Nothing in these Terms affects rights that you have under applicable consumer law.
SECTION 1 — ACCESS TO THE SERVICES
You may use the Services only for lawful purposes and in accordance with these Terms.
By placing an order, you confirm that you are at least 18 years old or otherwise have legal capacity to enter into the contract. If you are under 18, you may use the Services only with the involvement and permission of a parent or legal guardian.
You agree that information you provide, including contact, billing and delivery information, will be accurate, current and complete.
If you create an account, you are responsible for keeping your login details confidential and for activity carried out through your account. Please contact us promptly if you believe your account has been used without permission.
We may reasonably restrict or suspend access to an account where we believe it has been compromised, used fraudulently or used in material breach of these Terms.
SECTION 2 — PRODUCTS, CURATION AND PRODUCT INFORMATION
Unless a product is expressly identified as a LANYU original, it is designed, manufactured or supplied by its respective brand, artist, studio or manufacturer. Selling or displaying a third-party product does not by itself mean that LANYU owns the brand or has an exclusive or sponsored relationship with it.
When selecting products, we may consider factors such as design, materials, production method and suitability for journaling, planning or creative use. Individual preferences vary, and inclusion in our collection does not guarantee that a product will meet every personal preference.
We make reasonable efforts to ensure that product descriptions, measurements, photographs, colours and other information are accurate. Colours and appearance may vary because of screen settings, lighting, photography and the handmade, printed or small-batch nature of some products.
Small variations in colour, print placement, texture, cutting, finishing or packaging may occur and are not necessarily defects. This does not affect your rights where goods are faulty, not as described, not of satisfactory quality or otherwise do not meet legal requirements.
Product information may be corrected or updated for future purchases. A material change will not be made to an accepted order without your agreement unless required by law.
SECTION 3 — PRODUCT AVAILABILITY AND PURCHASE LIMITS
All products are subject to availability. Adding an item to your basket does not reserve it.
An item may become unavailable after an order is submitted because of stock-counting errors, damage discovered during packing or simultaneous purchases by different customers.
If we cannot supply an ordered item, we will contact you within a reasonable time. We may offer an alternative or restock option, but we will not substitute a product without your agreement. If the item is cancelled, any amount paid for it will be refunded to the original payment method.
Limited-edition, imported and small-batch products may not be restocked once sold out.
We may apply reasonable quantity limits. Before accepting an order, we may decline an order that we reasonably believe is fraudulent, breaches a stated purchase limit or is intended for unauthorised bulk resale or redistribution. This does not prevent ordinary gifting or the lawful resale of goods you own.
SECTION 4 — ORDERS AND CONTRACT FORMATION
When you submit an order, you are making an offer to purchase the products in your basket.
An order acknowledgement confirms that we have received your order but does not necessarily mean that it has been accepted. A binding contract is formed when we send confirmation that the order has been accepted or dispatched, whichever occurs first.
Before acceptance, we may decline or cancel an order for a reasonable reason, including product unavailability, inability to authorise payment, incomplete or inaccurate order information, suspected fraud or misuse, an obvious pricing or description error, an unavailable delivery address or breach of a stated purchase limit.
If payment has already been taken for an order that we decline or cancel, we will refund the relevant amount to the original payment method.
Please review your order carefully before submitting it. Once an order has been submitted, it may enter processing immediately. We do not offer a voluntary order-amendment or cancellation service after checkout. This does not affect any statutory right to cancel that applies under Section 8. Where we receive a valid cancellation notice after processing or dispatch has begun, we may be unable to stop the parcel and you may need to return the goods in accordance with Section 9.
SECTION 5 — PRICES, PROMOTIONS AND PAYMENT
Prices are shown in pounds sterling unless the store expressly displays another currency. Prices include VAT where VAT is applicable and LANYU is required to charge it. Delivery and other applicable charges will be shown before you confirm the order.
Prices may change from time to time, but a change will not normally affect an order that has already been accepted.
If there is an obvious pricing error that should reasonably have been recognised as a mistake, we are not required to supply the product at the incorrect price. We will contact you and offer the option to purchase at the correct price or cancel the affected item for a refund.
Promotional prices, discount codes and offers may have separate conditions, expiry dates, eligibility requirements, minimum spends and exclusions. Unless stated otherwise, only one promotional code may be used per order and codes cannot be applied retrospectively.
We may refuse or correct a promotion before order acceptance where it was issued in error or used fraudulently. We will not remove a valid discount from an accepted order without a lawful reason.
Payment methods and payment providers are shown at checkout. You confirm that you are authorised to use the payment method submitted and that the billing information is accurate. If payment is declined or reversed, we may withhold acceptance or dispatch until valid payment is received.
SECTION 6 — DELIVERY
Available delivery methods, estimated delivery times and charges are shown at checkout or in our Shipping Policy.
Delivery dates are estimates unless we expressly agree a guaranteed date. Unless another period is agreed, we will deliver the goods without undue delay and within 30 days after the contract is formed.
You are responsible for providing a complete and accurate delivery address. Contact us promptly if you notice an error. We cannot guarantee that an address can be changed after an order has been processed or dispatched.
Risk of loss or damage remains with us until the goods come into your physical possession, or the possession of a person identified by you to receive them. This does not apply where you independently arrange a carrier that was not offered by us.
If tracking shows delivery but the parcel cannot be located, please first check with household members, neighbours, reception and any nominated safe place, then contact us so that we can investigate.
If a parcel is lost or materially damaged in transit, contact us at contact@lanyupaper.com. Where appropriate, we will arrange the remedy required by law, which may include a replacement or refund.
SECTION 7 — INTERNATIONAL DELIVERY
International delivery is available only where a delivery option is shown at checkout. Estimated times and charges will be displayed before the order is confirmed.
International orders may be subject to import VAT, customs duties, handling fees or local taxes imposed by the destination country. Unless checkout expressly states that these charges are included, they are normally your responsibility.
Customs procedures may cause delays outside our reasonable control. You are responsible for checking that the products can lawfully be imported into and used in the destination country.
If an international parcel is returned because duties were not paid, delivery was refused or an inaccurate or incomplete address was supplied, we may deduct reasonable and evidenced return or carrier charges from the refund to the extent permitted by law.
SECTION 8 — STATUTORY RIGHT TO CANCEL
We do not offer an additional voluntary cancellation policy. However, if you are a consumer purchasing online, you will normally have a statutory right to cancel the contract without giving a reason. This legal right applies regardless of whether we are able to stop an order during processing.
The cancellation period begins when the contract is formed and normally ends 14 days after the day on which you, or a person identified by you other than the carrier, receives the goods. If one order contains items delivered separately, the period normally ends 14 days after receipt of the final item.
To cancel, you must clearly tell us of your decision before the cancellation period expires. You may email contact@lanyupaper.com or use the model cancellation form in the Appendix, but you do not have to use the form.
The cancellation right may not apply to products made to your specifications, clearly personalised products, sealed products not suitable for return for health-protection or hygiene reasons once unsealed, goods that become inseparably mixed with other items after delivery, or other products excluded by applicable law.
These exceptions do not affect your rights where goods are faulty, damaged, incorrect, not as described or otherwise do not meet legal requirements.
SECTION 9 — RETURNS AND REFUNDS AFTER CANCELLATION
After telling us that you wish to cancel, you must return the goods without undue delay and no later than 14 days after the day on which you told us.
Unless the goods are faulty, damaged, incorrect or not as described, you are responsible for the direct cost of returning them. We recommend a tracked or otherwise reliable service and keeping proof of postage.
You may handle the goods only as much as reasonably necessary to establish their nature, characteristics and functioning, in a similar way to how you might inspect them in a shop. If handling beyond this reduces their value, we may make an appropriate deduction from the refund to the extent permitted by law.
Please package returned items securely and, where reasonably possible, include the order number and contact details. Original packaging is helpful but its absence does not by itself remove your legal rights.
For a valid cancellation, we will refund the price paid for the returned goods and the cost of the least expensive standard delivery method offered by us. Any additional cost of an enhanced delivery service is not normally refundable unless the goods were faulty or we made an error.
We may withhold the refund until we receive the goods back or you provide evidence that they were returned, whichever occurs first. The refund will normally be issued within 14 days after that date, using the original payment method unless we agree otherwise. Your bank or payment provider may take additional time to process it.
SECTION 10 — FAULTY, DAMAGED OR INCORRECT GOODS
We are under a legal duty to supply goods that are of satisfactory quality, fit for their usual or agreed purpose and as described.
If a product arrives damaged, is faulty, is materially different from its description or is not the product you ordered, contact us as soon as reasonably possible at contact@lanyupaper.com
Please include your order number and, where helpful, photographs showing the issue. Photographs can help us assess the problem but will not be used to remove rights that you have by law.
Depending on the circumstances and your legal rights, the remedy may include a refund, replacement, repair where appropriate, price reduction or reimbursement of reasonable return costs.
Nothing in these Terms or our Refund Policy limits your statutory rights.
SECTION 11 — INTELLECTUAL PROPERTY
The LANYU name, logo, visual identity, original illustrations, website design, written content, packaging designs and products expressly identified as LANYU originals are owned by or licensed to LANYU.
Third-party brand names, logos, characters, illustrations, photographs and product designs remain the property of their respective owners.
You may access and use the website for personal and non-commercial purposes. Without prior written permission, you must not copy or reproduce substantial parts of the website, republish or commercially exploit its content, remove ownership notices, use LANYU branding in a way that suggests endorsement, or reproduce original product photography or descriptions for commercial purposes.
Nothing in these Terms transfers ownership of intellectual-property rights to you.
SECTION 12 — REVIEWS, PHOTOGRAPHS AND FEEDBACK
You may submit reviews, comments, photographs, product suggestions and other feedback. You are responsible for content you submit and must not submit content that is unlawful, misleading, defamatory, abusive, discriminatory, infringing or malicious.
Where you submit a review, photograph or other content through a feature that indicates it may be published, you grant LANYU a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for operating, improving and promoting the Services. You retain ownership of your underlying intellectual-property rights.
We may moderate or remove content that reasonably appears unlawful, misleading, offensive, irrelevant or contrary to these Terms.
A brand or product request does not guarantee that we will stock the requested item.
SECTION 13 — THIRD-PARTY SERVICES, TOOLS AND LINKS
The Services may use or link to platforms, payment methods, applications, tools or websites supplied by third parties, including Shopify and the payment providers shown at checkout.
Third-party services may have their own terms and privacy policies. Please review them where relevant.
To the extent permitted by law, we are not responsible for the independent content, availability, security, acts or omissions of third-party services that we do not control. This does not limit responsibility that cannot lawfully be excluded or your rights in relation to goods purchased from LANYU.
SECTION 14 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Please read the Privacy Policy before using the Services or providing personal information.
SECTION 15 — PROHIBITED USES
You must not use the Services for unlawful or fraudulent purposes; infringe intellectual-property, privacy or other legal rights; submit false or misleading information; impersonate another person or organisation; transmit malware or harmful code; interfere with the operation or security of the Services; attempt unauthorised access to accounts, systems or data; collect personal information without lawful authority; send spam; scrape content in a way that materially disrupts the Services or infringes rights; or harass, threaten, abuse or discriminate against another person.
We may take proportionate steps to prevent or respond to misuse, including restricting website access, suspending an account or cancelling an order before acceptance.
SECTION 16 — WEBSITE AVAILABILITY AND CHANGES
We aim to keep the Services reasonably available but do not guarantee uninterrupted or error-free access.
The website may be unavailable because of maintenance, updates, security issues, technical faults or circumstances outside our reasonable control.
We may change, suspend or discontinue website features where reasonably necessary. Changes to the website do not remove rights relating to an accepted order or rights that apply by law.
SECTION 17 — OUR LIABILITY
We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for loss or damage that was not reasonably foreseeable when the contract was formed.
We supply products primarily for private and domestic use. Unless we expressly agree otherwise, we are not responsible for business losses such as loss of profits, revenue, opportunity or business interruption arising from a consumer purchase.
Nothing in these Terms limits or excludes liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights relating to goods, defective products where liability cannot lawfully be excluded, or any other matter that cannot legally be limited.
SECTION 18 — EVENTS OUTSIDE OUR CONTROL
We are not responsible for delay or failure caused by an event outside our reasonable control, such as severe weather, natural disaster, postal or transport disruption, industrial action, internet or telecommunications failure, government action, import restriction or supplier interruption.
Where reasonably practicable, we will take steps to reduce the effect on an affected order and provide an update. If there is a substantial delay, you may have the right to cancel the affected order and receive a refund for products not supplied.
SECTION 19 — GENERAL LEGAL TERMS
If a provision of these Terms is found to be unlawful, invalid or unenforceable, it will be treated as removed or limited to the minimum extent necessary. The remaining provisions will continue in effect.
If we delay or fail to enforce a provision, this does not mean that we have waived the right to enforce it later.
These Terms and the policies expressly incorporated into them form the agreement between you and LANYU concerning use of the Services and purchases from the store. If policies conflict, the policy dealing most specifically with the issue will normally apply, subject to applicable law.
You may not transfer your rights or obligations under an accepted order without our written agreement, except where the law permits. We may transfer our rights or obligations to another organisation in connection with a sale or restructuring, provided that this does not reduce your rights.
A person who is not a party to the contract between you and LANYU will not normally have the right to enforce these Terms, without affecting rights available independently under law.
SECTION 20 — GOVERNING LAW AND DISPUTES
These Terms and contracts formed through the Services are governed by the laws of England and Wales.
If you are a consumer living in Scotland or Northern Ireland, you retain the benefit of mandatory consumer protections applicable where you live and may also be entitled to bring proceedings in your local courts.
Before starting formal proceedings, we encourage you to contact us so that we can try to resolve the issue fairly and promptly.
SECTION 21 — CHANGES TO THESE TERMS
You can review the current version of these Terms on this page.
We may update these Terms to reflect changes in the Services, business practices, technology or legal requirements. The version applying to an order is generally the version in effect when the order is placed.
Where a change materially affects existing rights or an ongoing service, we will provide notice where required by law. The “Last updated” date shows when this version was issued.
